Can the Court Order a Parent to Pay for College Expenses?

While college expenses for children is something we always recommend parties agree to, the quick answer is no, the court cannot order a parent to pay for college expenses.  However, if you agree that one or both parents will pay for college expenses, under certain circumstances, and with specificity, the Court will enforce the agreement.  There are very specific parameters regarding prior agreements and whether the provisions regarding college expense sharing are enforceable.  If you have questions or cannot agree about these issues with your former partner or spouse, contact us to discuss ways in which we can help.
